Welcome to Configra Parts. This website is owned and operated by Configra NZ Limited (New Zealand Business Number 9429032697704 / Company Number 2142280), trading as “Configra Parts” (“we“, “us“, “our“).

These Website Terms and Conditions (the “Terms“) apply to your use of our website www.configraparts.co.nz and to any goods or services you purchase through it. By using our website or placing an order, you agree to these Terms.

Please also read our Returns Policy and Privacy Policy, which form part of these Terms.

1. About these Terms

1.1 These Terms govern purchases made through our website by paying at the time of order (for example, by card). If you hold a trade credit account with us, your purchases are also governed by our Terms of Trade; where there is any inconsistency for a trade-account purchase, the Terms of Trade prevail.

1.2 We may update these Terms from time to time by publishing the updated version on our website. The Terms in force at the time you place an order apply to that order.

2. Using our website

2.1 You may use our website only for lawful purposes. You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious code, or interfere with its operation or security. Automated access, scraping or any form of content extraction is expressly prohibited.

2.2 We take reasonable care to keep the website available and accurate, but we do not guarantee it will be uninterrupted, error-free, or free of viruses. We may suspend, withdraw or change the website at any time without notice.

2.3 If you create a website account, you are responsible for keeping your login details secure and for all activity under your account.

3. Products, descriptions and pricing

3.1 We take care to describe and picture our products accurately, but images, specifications and packaging are provided as a guide and may differ slightly from the actual product. Compatibility information is provided in good faith — please check that a part suits your needs, and contact us if you are unsure.

3.2 Prices are shown in New Zealand dollars. Unless stated otherwise, prices include GST. Delivery charges are additional and are shown at checkout before you confirm your order.

3.3 We try to keep pricing and stock accurate, but errors can occur, and prices and availability may change. If we discover an error in the price or description of an item you have ordered, we are not obliged to supply it at the incorrect price. We will contact you to offer the correct price (which you may accept or decline) or to cancel the order and refund you in full.

3.4 Stock availability is not guaranteed. If an item becomes unavailable after you order, we will contact you to arrange an alternative, a backorder, or a full refund.

4. Orders and acceptance

4.1 Placing an order and paying through the website is an offer by you to purchase the goods. It does not, by itself, form a binding contract.

4.2 We will send you an order confirmation acknowledging that we have received your order. This acknowledgement is not acceptance of your order.

4.3 A binding contract is formed only when we accept your order, which occurs when we dispatch the goods to you (or notify you that they are ready for collection), or otherwise confirm acceptance in writing. We may decline any order – for example, where an item is unavailable, where there has been a pricing or description error, where we cannot verify payment, or where we suspect fraud. If we decline your order, we will refund any payment you have made for it.

5. Payment

5.1 Payment is due in full at the time of order unless you hold an approved trade account with agreed payment terms.

5.2 We accept the payment methods shown at checkout. Payments are processed by third-party payment providers; we do not store your full card details.

5.3 You confirm that you are authorised to use the payment method you provide.

6. Delivery

6.1 We deliver within New Zealand and internationally to select countries. Delivery charges and estimated timeframes are shown at checkout.

6.2 Any delivery date or timeframe is an estimate only. We are not responsible for delays outside our reasonable control, including courier and freight delays.

6.3 You must provide accurate and complete delivery details. We are not responsible for orders delayed or lost due to incorrect delivery information you provide. Please check the goods on delivery and let us know promptly of any damage, shortage, or incorrect item.

7. Risk and title

7.1 Risk in the goods passes to you when the goods are delivered to you or your nominated address, or collected.

7.2 Title to the goods passes to you once we have received payment in full and the goods have been delivered.

8. Cancellations and changes

8.1 If you need to change or cancel an order, contact us as soon as possible. We will do our best to accommodate a change before the order is dispatched, but we cannot guarantee it, and orders that have already been dispatched are subject to our Returns Policy.

8.2 Special-order and custom-configured items may not be able to be changed or cancelled once ordered – see our Returns Policy.

9. Returns and refunds

Returns, exchanges and refunds are dealt with in our Returns Policy, which forms part of these Terms. Please read it before purchasing.

10. Your consumer rights

10.1 Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply and cannot lawfully be excluded. If goods are faulty, not of acceptable quality, not fit for their purpose, or not as described, you are entitled to a remedy under those Acts.

10.2 Where you acquire goods for the purposes of a business, the Consumer Guarantees Act and certain provisions of the Fair Trading Act may not apply, as set out in our Terms of Trade.

11. Trade account customers

If you hold a trade credit account with us, your purchases are also subject to our Terms of Trade, including provisions relating to credit, payment terms, retention of title, and security interests.

12. Intellectual property

All content on this website – including text, images, logos, product descriptions, and design – is owned by us or our licensors and is protected by law. You may not copy, reproduce, or use our content for commercial purposes without our written permission.

13. Limitation of liability

13.1 To the maximum extent permitted by law, and subject to clause 10:

(a) our total liability to you in connection with any goods, services, or your use of the website is limited to the price paid for the goods or services giving rise to the liability; and

(b) we are not liable for any indirect or consequential loss, or for any loss of profit, data, or business.

13.2 We are not liable for any loss arising from your reliance on technical, compatibility or specification information, except to the extent your rights under the Consumer Guarantees Act or Fair Trading Act apply.

14. Third-party links

Our website may contain links to third-party websites. We provide these for convenience only and are not responsible for the content, products or privacy practices of those websites.

15. Privacy

We handle personal information in accordance with our Privacy Policy and the Privacy Act 2020.

16. General

16.1 These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts.

16.2 If any provision of these Terms is held invalid or unenforceable, it is severed and the remaining provisions continue in full force.

16.3 Our failure to enforce any provision is not a waiver of it.
